Terms of Service

1. Who we are

SuperSmart Moving (“SuperSmart,” “we,” “us,” “our”) is a moving-company CRM and operations platform. By accessing or using our service at supersmartmoving.com, app.supersmartmoving.com, or any associated subdomain (the “Service”), you agree to be bound by these Terms.

If you don't agree, please don't use the Service.

2. What the Service does

SuperSmart provides moving companies with software to:

  • Capture and manage leads
  • Build and send quotes
  • Collect customer signatures and deposits
  • Schedule moves and dispatch crews
  • Send and receive emails, text messages, and notifications
  • Track jobs, payments, and reporting

The Service is sold to moving companies (“Customer Companies”). Individual users of the Service are typically employees of a Customer Company (“Users”).

3. Eligibility and accounts

You must be at least 18 years old and authorized by your Customer Company to access the Service.

Each User must:

  • Provide accurate registration information
  • Keep their password secure
  • Notify us promptly of any unauthorized access
  • Not share their account with anyone else

We may suspend or terminate accounts that violate these Terms.

4. SMS / text message communications

This section is important - please read carefully.

By providing your mobile phone number to SuperSmart and accepting these Terms, you consent to receive text messages (SMS) from us related to your use of the Service.

The types of messages you may receive include:

  • New-lead alerts
  • Quote-sent or quote-accepted notifications
  • Deposit-paid confirmations
  • Job-status updates
  • Internal team notifications you've opted into through your account settings or Customer Company configuration

Message frequencyvaries and depends on activity in your Customer Company's account.

Message and data rates may apply. Check with your mobile carrier for details.

To stop receiving texts, reply STOPto any message we send. You'll receive one confirmation message and then no further texts from us, except as required by law or to confirm your opt-out.

Your phone number and SMS opt-in status are not shared with third parties for marketing purposes. See our Privacy Policy for details on data handling.

We use third-party messaging providers (such as Twilio and RingCentral) to deliver these messages. These providers are bound by their own terms and privacy policies.

5. Customer data ownership

Your Customer Company owns all data that it or its Users enter into the Service, including leads, quotes, customer information, files, and communications.

SuperSmart processes this data on behalf of your Customer Company to provide the Service. We do not sell Customer Data to third parties.

6. Acceptable use

You agree NOT to use the Service to:

  • Violate any law or regulation
  • Send spam, unsolicited bulk messages, or any communication you don't have permission to send
  • Harass, threaten, or defraud anyone
  • Reverse engineer or attempt to access systems you're not authorized to access
  • Interfere with the Service's operation or other users' use of it
  • Upload malware or any harmful code

Misuse of the SMS or email features (such as sending unsolicited messages to people who haven't opted in) may result in immediate account termination and reporting to carriers and regulators.

7. Payments and subscriptions

Customer Companies pay for the Service on a subscription basis. Pricing is set out in your subscription agreement.

Payments are processed by Stripe. Your card information is handled by Stripe and is not stored on SuperSmart's servers.

Subscriptions renew automatically until cancelled. Cancel anytime from your account or by contacting us - you'll keep access until the end of your paid period.

8. Third-party services

The Service integrates with third-party providers to function, including:

  • Firebase (Google) - authentication and data hosting
  • Stripe - payment processing
  • SendGrid - email delivery
  • Twilio - SMS delivery
  • RingCentral - voice and SMS
  • Google Maps - address lookup and routing

Each of these has its own terms and privacy practices that apply to your data when those services are used.

9. Service availability

We work hard to keep the Service available 24/7 but we don't guarantee uninterrupted service. We may schedule maintenance, deploy updates, or experience outages.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied.

10. Limitation of liability

To the maximum extent permitted by law, SuperSmart and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising out of your use of the Service.

Our total liability to you for any claim arising out of these Terms or the Service is limited to the amount you (or your Customer Company) paid us in the 12 months before the claim.

11. Changes to the Service

We may add, remove, or change features at any time. We'll give reasonable notice of material changes when we can.

12. Changes to these Terms

We may update these Terms occasionally. We'll post the new version here with an updated “Last updated” date. For material changes, we'll notify you by email or in-app notice.

Continued use of the Service after changes take effect means you accept the new Terms.

13. Termination

You may stop using the Service at any time.

We may suspend or terminate your access if you violate these Terms, fail to pay, or for other lawful reasons. We'll give reasonable notice when we can.

After termination, we may retain your data for a limited period as required by law or to comply with our legitimate business needs (see the Privacy Policy).

14. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in San Diego County, California.
